Introduction
The operator of the following websites: www.mawigroup.ch, www.mawisa.ch, www.mawienergie.ch, www.poseidonengineering.ch, www.plcons.ch, www.bilger-partner.ch, www.mawi-ingenieurs.ch and all sub-pages (hereinafter also referred to as “websites”) is mawi group SA (hereinafter referred to as “Company” or “mawi group”). The Company is a structured holding specialising in the various fields of engineering within the meaning of Article 60 et seq. of the Swiss Civil Code (CC), based in Lugano.
Mawi group consists of six companies:
- Marcionelli & Winkler + Partners SA, based in Bellinzona, Lugano and Locarno;
- mawi energie SA, based in Locarno, Bellinzona and Lugano;
- Poseidon engineering SA, based in Bellinzona;
- mawi ingénieurs conseils SA, based in Lausanne;
- Pagani + Lanfranchi SA, based in Bellinzona;
- bilger + partner AG, based in Altdorf.
Data is processed on our websites in accordance with the guidelines below, which have been drawn up within the limits of the new Swiss Federal Data Protection Act (DPA).
More information will be made available upon request or as part of the establishment of a business/agency relationship with the Company. In this context, we merely specify in detail which data are processed and how they are used in the course of a possible mandate, which depends to a large extent on the services to be provided or agreed upon from time to time.
- Who is the data processor?
Mawi group is the data processor for your personal data in accordance with this policy.
- Which personal data are collected?
In the course of our professional activity we collect and process personal data (i.e. data directly or indirectly concerning natural persons) in particular relating to our clients, third persons involved in the Company’s projects and their collaborators, and visitors to our websites.
More specifically, we process your personal data when you visit our websites and/or contact us by e-mail, telephone and/or fax, or in person.

These data include your IP address and other contact data provided by you, such as your surname, first name, telephone and/or telefax number, date of birth, e-mail address, etc. We only collect data that you have made available to us (directly or indirectly) or that you have consented to us obtaining, and data from publicly accessible sources, such as the press, internet, etc.
For example, in relation to mandates with our clients, we process the following personal data:
- Client data and mandate management data: client’s first name, surname and contact data, date of birth, role and title, possible interrelationships, information from publicly accessible sources (e.g. Commercial Register), content of the request and mandate.
- Mandate data: communications with the client, authorities and other stakeholders involved in the project, project documentation, list of services provided, invoices, payments and bank details.
When you visit our websites, our servers temporarily store each access in a log file. The following user and device data, as well as personal data, are collected and stored by our hoster (ISP - Internet Service Provider) without any action on your part:
- the IP address of the requesting computer;
- the date and time of access;
- the name and URL of the recovered file;
- the website from which the access was made;
- the operating system of your computer and the browser you are using;
- the country from which the access was made and the language settings of the browser.
If you disclose the data of other natural persons (e.g. family members, representatives or other persons) to us, please ensure that they are aware of this policy and that you will only share their personal data with us if you are authorised to do so. If you provide us with data from third parties, we will assume that you are duly authorised to do so.
- For what purposes do we process your data?
If a mandate is established between you and us, we will process your personal data within the scope of the mandate. The main purpose of processing personal data is to communicate with the client and to respond to their requests and to provide, document, invoice and improve our performance and services.
We may need your data in particular:
- in the event of an application: if you apply for a job with us, we will obtain and process the relevant data for the purpose of examining your application, completing the application process and, in the event of a successful application, for preparing and concluding the relevant contract;
- for marketing, promotional and other purposes: where you have provided us with consent to process your personal data for specific purposes, we will process your personal data within the scope and on the basis of that consent. The consent given may be revoked at any time, but this will not affect the data processing that has already taken place;
- to fulfil our legal and contractual obligations;
- to interact with third parties such as other professionals in the field (both nationally and internationally); and
- for the management of our websites: In order to operate our websites securely, we collect technical data, such as your IP address, the time and mode of use, information about your computer’s operating system and the browser you are using, and your device settings. We also use cookies and similar technologies. You can find more information on this under point 7.
- To whom do we disclose your data?
In order to diligently execute the mandate, your personal data may be shared, on Swiss soil, both within the Company and externally, for example with public authorities, insurance companies, IT service providers, who may have access to your personal data in the context of IT support, cloud providers and other actors in connection with the mandate.
Your personal data will not be transmitted abroad without your explicit consent.
- How do we store your data?
We store personal data for as long as is necessary to fulfil contractual and legal obligations and to carry out the activities described in point 3 above.
- What are your rights?
You have certain rights in relation to our processing of your data. More specifically, you have the following rights:
- the right to information and access to one’s personal data;
- the right to withdraw consent;
- the right to correct, update or rectify inaccurate personal data;
- the right to have one’s personal data erased;
- the right to restrict or object to the processing of personal data; and
- the right to the portability of your personal data;
The exercise of your rights requires you to prove your identity (e.g. by means of a copy of your identity document). To exercise your rights, you may contact us at the addresses specified in point 8.
In addition, under the DPA, the data subject has the option to contact the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).
- Why we use cookies
We use cookies to optimise our offer, the efficiency and security of our websites. Cookies do not harm your computer. By changing your browser settings, you can choose whether to be informed of the presence of cookies, whether to accept or reject them, as well as whether to deactivate them at the end of a browsing session. Deactivating cookies may affect the user experience of our websites.
- Other information
The Company is required by law to protect privacy and secrecy; for this reason, it takes a number of technical and organisational measures to protect personal data from unauthorised access and misuse. This includes training our employees and adopting technical security solutions such as setting access restrictions.
The Company reserves the right to amend this policy without prior notice and at any time within the scope of the provisions of the law. The version published at www.mawigroup.ch/privacy-policy is the current one. We therefore advise you to regularly consult this privacy policy.
